INFORMATION AND DATA MANAGEMENT
To manage your purchases, provide services (to the Customer), and fulfill other requests
Orders, purchase, and accounts
Online, when you purchase an item through our website, we collect your name and the name of your company (if you are a small business), your full postal or separate billing address, email address, items ordered and returned, delivery information, invoice information, and other data related to fulfilling your order. We also collect data on the use of your coupons (e.g., validity and amount) or gift cards. Additionally, we collect data you choose to provide in additional fields, such as your date of birth and phone number.
We use this data because it is necessary to conclude, execute, and manage your purchase and manage your order. Please note that, in some cases, the requested information may be mandatory. If you do not provide a name and delivery address, we will not be able to deliver your items.
During the purchase process, you will be presented with the option to set up a personal account. If you choose to do so, we will request additional information, such as setting up a personal password, date of birth, and subscriptions to commercial communications.
In our online store, depending on whether you are a consumer, we collect your name, address, and other relevant personal data if necessary to meet local tax and legal requirements. We may need this information to issue a refund or a tax receipt (VAT receipt). If you have opted to receive an electronic receipt, we will process your email address. This data is collected through our online store.
Customer service and other requests
We also collect data to respond to your phone or email inquiries. In such cases, we will only request the necessary data to process your inquiry (to manage our contractual relationship with you or to comply with a legal obligation). For example, if you contact us regarding the return of items, we may ask for the date and place of purchase or information about your decision to return the items.
When you interact with chatbots (automatic messengers), we will also record your responses to these chatbots, how you interact with them, and store data related to the device you use. Depending on the chatbot platform and your permission, we may collect device data such as IP address, social media alias, time zone, country, and GPS location. The platform providing the chatbot may also collect some of this data. For example, if the chatbot is provided on Facebook, Facebook may also collect your user data. We also collect other information related to fulfilling your request, such as the chat content.
We can process this data because it is necessary to manage our contractual relationship with you if your request is related to an order, or because we have a legitimate interest in helping you and, consequently, improving our services.
Terms, conditions, or notices (modified)
We are legally required to inform you about any (changes to the) terms and conditions and notices that apply to our relationship with you. To comply with these legal obligations, we may use your contact details, such as your email address, to keep you informed.
Payments and checking for fraudulent credit card use or excessive canceled charges on the credit card
If you purchase something from us, we need to process your personal data to be able to process your payment. Your data will be shared by the payment providers we work with. These payment providers are also responsible for processing your data used for payment purposes. If you have any questions about how payment providers use your personal data, please contact them directly.
If you wish to pay for your order by credit card, a credit check will be carried out to confirm that your personal data is not associated with the fraudulent use of credit cards or excessive canceled charges on the credit card. For this purpose, our payment service provider will use your name and bank account details. We do not collect information related to the payment instrument you use, such as credit card information. This information is only processed by our payment service provider and payment instrument providers under strict information security guarantees. We carry out this check to protect our legitimate business interest in preventing fraud and financial loss, or to comply with our legal obligations.
To maintain our relationship with you through (digital) marketing initiatives and social listening
Newsletters, promotional communications, or links in an email
When you give your consent or when we have a legitimate interest in doing so, we will collect your email address or mobile number and/or your postal address to send you our newsletter and other commercial messages. Additionally, we will keep a history of the email and SMS messages we send you and record what you do with these messages (e.g., if you open them or click on their content). Please note that you can unsubscribe at any time via the "Unsubscribe" button below each email, or ask us to do so through the contact details provided below or in the relevant commercial message.
Personalized experience and improving the online experience
When you visit our websites, we will place cookies, pixels, and other digital tools with similar functionality ("cookies") on your browser or device that allow us to better understand and personalize your experience with us and our communication and marketing directed to you.
Our use of cookies, pixels, and other digital tools with similar functionality is described in more detail in our cookie policy.
Targeted and personalized advertising
Based on your online and offline purchase history, your behavior on websites (pages visited, links you accessed), and your interaction with chatbot(s), we will set up and maintain your personal digital marketing profile to ensure that we only show you ads that are likely to suit your personal taste. This is called targeted advertising. The better our targeted advertising, the greater the satisfaction of our (potential) Customer.
To show you specific ads, we may also match your data profile with customers who have a similar profile.
To support our targeted advertising, we use a Data Management Platform ("DMP"). In the DMP, information is collected about how our consumers respond to our products, brand, and advertising. This information is collected from various sources available to us offline, online, and via mobile, for example, when you visit our website. Additionally, it is enriched with information collected by others, such as data related to local weather. Based on that information, the DMP can help our marketing teams find and define relevant online audience segments for direct marketing campaigns to better reach them, within and outside David Muñoz Guardia's digital channels. If your digital marketing profile belongs to one of these segments, you will likely receive our advertising tailored to the interests of the segment we place you in on Facebook, Google properties, online properties of so-called affiliated parties, and other online and offline locations and materials, which is targeted advertising.
We may also use the data for retargeting, showing you a targeted ad on a third-party website linked to an event on our website, for example, a specific purchase that was abandoned.
Additionally, Facebook, Google, and other social and online actors may independently record your use of our ads. We recommend that you read the privacy policies of these third parties, as we are not responsible for the personal data they process for their own purposes.
You can ask us to delete your digital marketing profile by sending an email to davidmunozguardia@mail.com
We only use your data for targeted advertising if you have given your consent for the placement of cookies and the collection of personal data through the cookie. Our use of cookies, pixels, and other digital tools with similar functionality is described in more detail in our cookie policy.
Participation in sweepstakes and contests
When you participate in sweepstakes or contests, we request your name, postal address, email address, and phone number so that we can administer the sweepstakes or contest, identify participants, and, if necessary, notify winners. For some sweepstakes and contests, we need your data to meet legal obligations and for our legitimate interest in running the sweepstakes or contest. If the specific sweepstakes or contest has specific terms and conditions regarding the processing of your data, these will be shared with you as part of the participation process.
